Visitation Service Terms

These terms form part of the Just Comfort Shoes Terms and Conditions.

Just Comfort Shoes operates a Visitation Service allowing customers to try on and buy shoes in their homes. By seeking an appointment, customers agree to the following terms.

Shoe-fitting appointments attract a fee that may change from time to time.

Customers are responsible for the accuracy of the information they provide. By using the service, customers warrant that the arrangements of a shoe-fitting visit do not breach any rules or requirements applicable to the appointment location.

Customers may phone 0432 307 672 to cancel or make changes to their appointments, subject to the following conditions.

No refund is available if you cancel an existing appointment after our representative leaves our shop to travel to your appointment, or if you choose an unsuitable or problematic location that is not resolved prior to our confirmation of your booking. A cancellation fee of $20 applies if you cancel or change an appointment less than 24 hours before the appointment but before we set out from the shop to visit you. This fee is taken out of any refunded amount upon cancellation, or added to the fee for a new appointment. Cancelling or changing your appointment time more than 24 hours before a booked appointment is free of charge, but re-scheduling will depend on our availability.

Appointments that Just Comfort Shoes is unable to attend or chooses not to attend because the customer-provided appointment location is inaccurate, or fails to have parking available within 30m, or is not a ground-floor or lift-accessible residence, may be cancelled without refund of the visit fee unless conditions match alternative arrangements we have agreed to.

Appointments, including those already booked and/or paid for, are subject to the viability of arrangements and to other factors such as vehicle and personal access to the premises, access for goods, regulations for business visits at the location, the availability of 3G data to operate card payment facilities, traffic, weather and the availability and reliability of vehicles and equipment.

While we endeavour to provide the service as intended, we reserve the right to cancel available appointment times and confirmed appointments, without notice for any reason and without compensation to customers except to refund the whole or part of the visit fee that the terms do not disqualify the customer from receiving. We do not guarantee that we will be able to confirm a booking, offer shoes for sale or shoes that suit preferences indicated or that suit a particular purpose or foot, nor that we will attend an appointment, arrive in a timely manner, complete the appointment or complete a fitting.

Goods remain the property of Just Comfort Shoes until paid for in full. By using the service, customers agree to receive a handwritten or emailed receipt or tax invoice in the event that a printed receipt or tax invoice is not available.

Shoe-fitting visits cannot be used for customers to receive delivery of Special Orders. Special Orders need to be received in accordance with our Special Orders policy, which requires either in-store pickup or a freight cost for forwarding by mail.

The Visitation Service cannot be used to return previously purchased shoes. Returns should follow the process described in our Returns Policy. Returns of shoes purchased at a shoe-fitting visit may be returned in store or by mail using the process that applies to phone or online purchases, subject to our Returns Policy.

The Visitation Service cannot be used for Department of Veterans' Affairs Medical Grade Footwear fittings, though home visits for DVA MGF are possible under other arrangements if required according to a DVA MGF prescription, in which case the visit is free to the client.

Just Comfort Shoes shall not be liable for any loss or damage that customers incur as a result of its non-performance of any intended function of a Visitation Service appointment. Customers may be liable for loss or damage that Just Comfort Shoes incurs as a result of any harmful act or omission by the customer, including the use of an unsafe location or premises, or inaccurate information about the premises, its condition or its rules.

BY REQUESTING A VISIT, THE USER WARRANTS:

THAT JUST COMFORT SHOES SHALL NOT BE IN ANY WAY LIABLE TO THE USER OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR LOSS OF MONEY, GOODWILL, REPUTATION OR DATA ARISING FROM THE USER’S USE OF THE SERVICE OR ITS RELATED WEBSITE FUNCTIONALITY;

THAT THE USER WILL NOT HOLD JUST COMFORT SHOES RESPONSIBLE FOR OTHER USERS’ ACTS OR OMISSIONS.

THE USER AGREES THAT JUST COMFORT SHOES CANNOT GUARANTEE CONTROL OVER THE PERFORMANCE OR ACCURACY OF ONLINE FORMS, AUTOMATED EMAILS, OTHER COMMUNICATIONS, OR THE ACCURACY OF INFORMATION CONTAINED ON THE WEBSITE CONCERNING THE VISITATION SERVICE.

Should Just Comfort Shoes, in its sole discretion, determine that any party has breached these Terms, then nothing herein shall prevent or in any way restrict its right to pursue any of its legal and/or other remedies, including, without limitation, court action.
